1. About These Terms
These Terms of Service ("Terms") govern your use of the Tonaily platform available at tonaily.com and app.tonaily.com (the "Service"), operated by GROUPE GARAN, a French SAS registered under SIREN 953 558 582, headquartered at 200 rue de la Croix Nivert, 75015 Paris, France.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Tonaily is an AI-powered SEO content marketing platform. The Service includes keyword research, content generation, performance tracking via Google Search Console integration, and other features as described on the website.
We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of significant changes in advance.
3. Account
You must provide accurate information when creating your account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 16 years old to use the Service.
4. Pricing and Payment
Paid plans are billed monthly or annually as selected at checkout. Prices are displayed in euros and exclude applicable taxes unless stated otherwise.
Payments are processed securely by Stripe. By subscribing to a paid plan, you authorize recurring charges until you cancel.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No pro-rata refunds are issued for partial periods.
5. Google Search Console Integration
To use certain features, you may connect your Google Search Console account via OAuth. By doing so, you authorize Tonaily to access your Search Console data as described in our Privacy Policy.
You can revoke this access at any time from your Google account settings or from within Tonaily. Revoking access will disable features that depend on Search Console data.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its infrastructure
- Reverse-engineer, scrape, or extract data from the Service beyond what is provided through normal use
- Resell access to the Service without our written consent
- Use the Service to generate content that is misleading, defamatory, or infringes third-party rights
We reserve the right to suspend or terminate accounts that violate these Terms.
7. Intellectual Property
Our IP: The Tonaily platform, brand, code, design, and documentation are the exclusive property of GROUPE GARAN. These Terms do not grant you any rights to our intellectual property beyond the right to use the Service as intended.
Your content: You retain full ownership of the content you create using Tonaily. We do not claim any rights over your content. We may store it solely to provide the Service.
8. AI-Generated Content
Tonaily uses artificial intelligence to assist in content creation. AI-generated content is provided as a starting point and may contain inaccuracies. You are solely responsible for reviewing, editing, and publishing any content generated through the Service.
9. Availability and Warranties
We strive to keep the Service available 24/7 but do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of Liability
To the maximum extent permitted by applicable law, GROUPE GARAN's total liability for any claim arising from or related to the Service is limited to the amount you paid for the Service during the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost data, or business interruption.
11. Termination
You may close your account at any time by contacting us at contact@tonaily.com. We may terminate or suspend your account if you breach these Terms, with prior notice when reasonably possible. Upon termination, we will delete your data within 30 days, except where retention is required by law.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notification at least 15 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law and Disputes
These Terms are governed by French law. Any dispute arising from these Terms or the Service will be submitted to the competent courts of Paris, France. If you are a consumer resident in the European Union, you may also use the EU Online Dispute Resolution platform.
